What are the consequences of not filing Form 3520-A when required?

Failure to file Form 3520-A or to provide complete and accurate information can result in significant penalties. The initial penalty is equal to the greater of $10,000 or 5% of the gross value of the trust's portion attributable to the U.S. owner for each year the form is not filed.
